Apple Appeals to Guangdong Higher Court on iPad Trademark Case

Proview International recently stated that Apple Inc. and its agent IP Application Development have appealed to the Guangdong Higher People's Court against the previous losing iPad trademark case.

Apple's lawsuit request includes the ownership of the IPAD trademark registered in the Mainland and the exclusive right to use the IPAD registered trademark, and compensation for trademark ownership investigation fees and attorney fees totaling 4 million yuan.

The case that Apple sued Proview International on its infringement of trademark rights on November 17 was rejected by the Shenzhen Intermediate People’s Court and it was appealed to the Higher People’s Court of Guangdong Province on January 5 this year.

Apple made several appeals on this occasion, including the opinion that the case should apply to the legal determination of the Hong Kong Special Administrative Region; Shenzhen Proview passed a written authorization to a subsidiary of Proview International Holdings Limited (hereinafter referred to as Proview International) in Taiwan. The electronic signing of the trademark transfer agreement is an anonymous agency act. It should be determined that all of the iPad trademarks of Shenzhen Proview have been transferred to Apple. In addition, Apple will add Proview Electronics as the defendant.

It is reported that Proview will infringe upon Apple's infringement and demand that Apple compensate 10 billion yuan (1.5 billion U.S. dollars) and may enter into a licensing agreement at a price of several billion yuan.
